Half of San Diego college students text and drive, study says Comments Off

A new study reports that despite legislation prohibiting the practice, a significant majority of college students in the San Diego area use their cell phones while driving. According to a representative from the California Highway Patrol, college students are often over confident in their ability to perform multiple tasks while operating a moving automobile. The study surveyed nearly 5,000 students at San Diego area colleges including the University of San Diego, San Diego State University, California State San Marcos, the University of California San Diego, and eight other area colleges, of the estimated 78 percent of the students surveyed reported using a mobile phone to talk or text while behind the wheel of a moving motor vehicle, onlyone in four students reported habitually using a hands free device when driving. About 50 percent of the students surveyed reported sending text messages while driving on the freeway, 60 percent said they text message in city street stop and go traffic, and 87 percent reported sending text messages while stopped at a traffic light. Only 12 percent of the students surveyed reported abstaining completely from text messaging while driving.

Nestle recalls frozen lasagna due to packaging error Comments Off

At the request of the United States Department of Agriculture’s Food Safety and Inspection Service, Nestlé Prepared Foods Company, headquartered in Gaffney, South Carolina, has announced a voluntary recall of nearly 17,000 pounds of frozen Stouffer’s lasagna entrees because of a packaging mistake. These frozen lasagna entrée packages — 8 ounce packages labeled Stouffer’s Lasagna Italiano imprinted with a best used by date of January 2014 — may have been erroneously packed with stuffed peppers. This packaging error may cause a health issue to consumers with food allergies because these stuffed peppers contain Worcestershire sauce which includes anchovies, an allergen that is not declared on the ingredients list on the back of the lasagna packaging. Cases labeled Stouffers DS STFD Peppers contain a dozen packages that may potentially be wrongly labeled Stouffer’s Lasagna Italiano. The cartons have been printed with establishment number EST. 7991 and package code 1349595513R or 1349595513S. The individual packages are imprinted with universal product code 13800 44709. The products affected by this recall were manufactured on December 15, 2011 for distribution to retail outlets east of the Mississippi River. The company has received two consumer reports involving incorrectly packaged stuffed peppers to date.

Peugeot China recalls nearly 65,000 vehicles Comments Off

Peugeot Citroen China has announced a voluntary recall of nearly 65,000 vehicles, according to the General Administration of Quality Supervision, Inspection and Quarantine, a consumer advocacy group located in China. Peugeot’s model 207CC, 3008 and RCZ vehicles manufactured from June 2010 and March 2011. The engine pistons in these vehicles may become damaged from disproportionate mechanical force potentially weakening the vehicle’s accelerating power and possibly causing it to completely cease functioning unexpectedly, potentially increasing the odds the vehicle will become involved in a traffic accident. The company is also recalling more than 63,000 Citreon C5 vehicles manufactured from September of 2009 to October of 2011 due to a defective rear axle bolt that might fracture during heavy use, posing potential safety issues and increasing the danger that the vehicle will be involved in a collision that could lead to serious injury or death. The Dongfeng Peugeot Citroen Automobile Company will begin informing owners affected by these recalls of the potential safety issues posed by these vehicles. Owners of these vehicles can return them to authorized dealerships where these issues will be repaired free of charge.

KFC Owes Australian Girl $8 Million for Salmonella Infection Comments Off

Millions of dollars are going to a victim of a fast food product infected with salmonella.

An Australian girl and her family brought a suit against Kentucky Fried Chicken.  They say that a food item known as a chicken Twister Wrap that the then seven year old girl consumed in Sydney contained salmonella.  This, they say, prompted the girl to suffer a brain injury known as salmonella encephalopathy.  It caused the girl to incur a blood infection as well as to undergo septic shock.  Additional ongoing injuries include spastic quadriplegia and severe impairment of speech, motor, and cognitive function.

The incident took place nearly seven years ago.  Finally, after years of litigation, the New South Wales Supreme Court determined that KFC owes the girl $8 million (about $8.3 million in American currency) plus legal costs.  The monetary damage announcement was made today.

The infection of the Twister wrap allegedly came about because proper food handling guidelines were not followed by at least one KFC employee, and maybe more.  KFC has stated that they intend to appeal the decision, but have not done so since the final ruling came down a week ago.

Southern California Rain Causes 115 Crashes in One Morning Comments Off

I reported yesterday on how rainy conditions spelled trouble in the city of San Diego, but the roads were just as perilous for drivers in other areas as well.

In fact, between 4 o’clock and 9 o’clock in the morning, the California Highway Patrol reported 115 distinct accidents.  Compare that to the 55 crashes which took place around the same time a week ago, when it didn’t rain, and it becomes clear that the conditions caused some damage.

Take Pasadena, for instance.  While a semi trailer was traveling west along the 134 Freeway, it took the onramp to the 210 Freeway and jackknifed, apparently due to a loss of traction which may have resulted from the rain.  The tractor trailer collided with the guardrail along the road, forcing authorities to close the ramp for hours.

The Angeles National Forest also felt the effects of the inclement weather.  Backroads in the area became so muddy that a sport utility vehicle became stuck.  A helicopter had to be dispatched to look for the SUV and its four passengers.  When they finally came upon the automobile, an individual with minor injuries was treated.

I think as an Oakland car accident lawyer that this is the perfect time to warn people about the dangers of rainy weather conditions.  Roads are dangerous on the best of days, but when they become slick, the hazards become severe.  I hope as a personal injury attorney in Oakland that everyone understands how harmful inclement weather can be.

Big Rig Drifts Off Interstate 80 and Crashes in Truckee Comments Off

Another single vehicle accident took place along California roads, except this time the vehicle in question wasn’t a car but a big rig.

The crash took place in the city of Truckee at around 10 o’clock in the morning yesterday.  A tractor trailer belonging to Wal Mart was headed west along Interstate 80.  According to the California Highway Patrol, the driver of the semi fell asleep at the wheel around the time that the vehicle approached the offramp to Donner Pass Road.  The vehicle drifted off the interstate and onto the exit ramp, at which point it careened off the pavement.

The big rig, which was carrying milk, eggs, and other assorted food products, came crashing down on its side along the freeway.  The driver of the tractor trailer was not injured as a result of the crash, and officers have reported that no other vehicles were involved in the incident.

Following the crash, officials arriving on the scene had to take care to remove potential environmental hazards.  10 gallons of oil and approximately 125 gallons of fuel were taken away from the truck while officers focused on cleaning the roadway and nearby area.

Lucerne Pickup Truck Crash Along Highway 20 Proves Injurious Comments Off

Lucerne was the site of one of the latest injurious crashes along California roadways.

It happened shortly after 7 pm last night.  A pickup truck was reportedly traveling down Highway 20 at an undisclosed speed.  When the vehicle reached the area west of Foothill Drive, it rolled over for reasons that have yet to be made known.  The vehicle came to a stop on its side right in the path of vehicles going east down the freeway.  Not long after that, the entire highway had to be shut down as a result of the single vehicle crash.

Northshore Fire Protection responded to the scene to assist the persons involved in the accident.  They found two people standing outside the wrecked vehicle.  One individual had to be taken to Santa Rosa Memorial Hospital to be treated for what were described as major injuries.  That person was transported via ambulance to a landing zone in Lucerne Harbor Park, where a helicopter made the second leg of the trip.  Another injured person sought assistance at Sutter Lakeside Hospital.

The California Highway Patrol reported on the incident.  Firefighters were out of the area shortly after 8 pm, when the highway could be opened back up.

Pedestrian Fatally Struck by Pickup Along SR-111 in El Centro Comments Off

Yesterday saw a pedestrian suffering injuries that turned out to be fatal after being struck by a vehicle while crossing the road.

The site of the tragic accident was El Centro.  A Chevy pickup truck was headed north along State Route 111 at around 50 miles per hour.  When the truck reached the area just south of Niland Avenue, a person reportedly and unfortunately walked out in front of the truck along the route.  According to the California Highway Patrol, the individual was wearing dark clothing.  Combined with the darkness of the night, it made that person hard to see.

The truck reportedly attempted to swerve out of the way so as to avoid colliding with the pedestrian, but it was to no avail.  The right mirror crashed directly into the person, sending the individual falling to the ground.  The CHP responded to the scene, and air transport was called so that they could attempt to take the pedestrian to the hospital.  Sadly, the impact of the crashed caused the person to die.

It would appear that the driver of the pickup didn’t sustain any injuries.

Jetta Careens Off Road in Injurious Lakeport Crash Comments Off

California roads witnessed yet another single vehicle crash that sent the driver of the automobile to the hospital to be treated for injuries.

This time, the event took place in the city of Lakeport in Lake County.  A Volkswagen Jetta was traveling in an undisclosed direction down the 29 Freeway just after 11 o’clock at night on Wednesday.  At some point on the driver’s commute, the vehicle, which officers from the California Highway Patrol say was going the speed limit, drifted off the road in the area just north of Mockingbird Lane.

After careening off the highway, the Jetta rumbled along and crashed into a fence in the area.  No word on what kind of damage was done to the vehicle or property, but the driver, who was the only occupant, incurred a bloody nose and cuts to her face.  The Upper Lake Fire Protection District arrived on the scene to assist the woman.  She was taken to nearby Sutter Lakeside Hospital to receive treatment for her injuries.

The CHP is in the process of investigating the crash.

Motorcycle Safety month promotes biker awareness Comments Off

The federal government has declared May as National Motorcycle Safety Awareness Month to remind motorists to keep an eye out for motorcyclists and motorcyclists to make an effort to make themselves more visible to motor vehicle operators. Warmer weather means more motorcycles on American roadways and more collisions involving motorcyclists. Motorcycles are smaller and quicker than automobiles, and more difficult to see on the roadways, especially when they are approaching from the side. Last year 671 motorcycle collisions occurred in the state of Missouri, including 644 accidents causing severe injuries and 82 fatalities. The state of Missouri has launched a campaign to support this public safety awareness effort by reminding motorists to “Watch for Motorcycles.” Safety experts advise that drivers can avoid becoming involved in a collision with a motorcyclist by carefully checking their side mirrors and blind spots for motorcycles before changing lanes, signaling before making a lane change, allowing motorcycles to occupy an entire lane, and maintaining a five second following distance. Experts also advise that motorcyclists signal turns with both turn signals and hand signals, avoid riding in inclement weather conditions, and always wear a safety helmet compliant with safety guidelines.
