Authorities have identified a toddler who died after falling from a luxury suite at Staples Center in Los Angeles after a Lakers game as reported by the San Francisco Chronicle on November 22, 2010. Yes, this is a horrible story. Anyone who has children gets a sick feeling in their gut after reading this story.
What are the liability issues? Some people think that because the accident happened inside of a business it is automatically the fault of the business. This is not true. To win this case, you must show that the owners of the Staples Center acted negligently. Maybe, there was a design defect with the luxury boxes. Is it foreseeable that a toddler would be in a luxury box? What about the parents? What were they doing? If liability is found against the owners of the Staples Center, the parents will likely be found to be comparatively negligent for not watching their toddler more closely.
