A 55-year-old Wilton man died this morning when the motorcycle he was riding was involved in a collision on northbound Highway 99 north of 47th Avenue as reported by the Sacramento Bee on November 9, 2010. The accident occurred about 9:55 a.m. when a Mercury Sable driven by a 17-year-old boy swerved out of control into the center median, according to the California Highway Patrol. The driver overcorrected, causing the vehicle to travel back into the northbound lanes, where it collided with a Harley Davidson motorcycle, propelling the rider from the motorcycle.
As a plaintiff’s personal injury lawyer, this appears to be a very strong case for the decedent’s family. However, there are many other issues besides liability. With regard to damages, it does make a difference of whether the decedent is married or single. Why? Well because the damages increase if the decedent was supporting his family. The type of job matters. Why? Well because the decedent’s income is going to matter when establishing a value to the case. The higher the income, the greater the value of the case.
