The driver of a big rig that killed a female bicyclist near Portola Valley earlier this month was involved in a similar crash in Santa Cruz three years ago that left a popular high school teacher dead, a California Highway Patrol spokesman confirmed Monday as reported by the Mercury News on November 16, 2010.
Some people may think this is a slam dunk case, but most of time when dealing in law, nothing is a slam dunk. The first accident that the truck driver was involved in was ruled not his fault. In the truck driver’s second accident, there were no independent witnesses and the bicyclist is dead. Therefore, it is more difficult to gather evidence against the truck driver. If a lawsuit is filed against the truck driver by the Estate of the Deceased, the attorneys for the truck driver would try to keep the truck driver’s past record out of evidence arguing that this information is highly prejudicial and provides little or no probative value.
